So this may be a long story... My spouse was walking the dogs on a Friday morning, he was about 20 minutes in the walk when he came across an older male walking towards him going the opposite way. He said he noticed the man was uneasy. He greeted him with a 'hello' and 'good morning' to assure him the dogs were okay, and the guy ignored him and very hostilely told him "Hold your dog back" Which my spouse did. Our dog was a bit tense and kinda lunged at him (but there was NO contact), the guy freaked out and jumped back. My spouse asked if he was okay and the guy started screaming at him and threatening him. My spouse had the dogs held back and them to sit while he tried talking to the guy. The guy called 911 and continued threatening my spouse. He claimed the dog bit him on his hand and he was bleeding, he kept screaming to have my spouse arrested and refused to give them his info and refused an ambulance to come out (all evidence in the copy of the 911 call) My spouse then tried giving the guy his information (so he can give it to the operator) in which the guy replied "are you trying to be a smartass?" My spouse decided to continue walking as the guy became increasingly hostile. The guy then began to follow him, (still on the phone) and said "let me catch you on these streets without those dogs!" he continued following him for about 25 minutes! Eventually the guy stopped and the cops arrived. The cops took my spouses statement and even met and saw the dogs and they were very submissive to them. They didn't file a report but sent it to Animal Control. Animal control showed up later at our home and said the dog had to be quarantined due to his rabies expiring a week before. We now have court next month to fight the bite allegation EVEN THOUGH there was NO contact and the gentleman was being completely hostile for no reason. I called the PD to get the officers info and a copy of the incident and they said the guy was very rude and uncooperative and my spouse and the dogs seemed fine. In addition to that, later that week we found out he lives in our complex as we saw him when we walked our dog in there. He again very hostilely (but with a STICK this time) asked "are you gonna bring that dog around me" to which we replied no, and told the dog to sit and asked him to walk ahead of us so we can go around him. He just stood there and pulled out his phone to (we found out later) call animal control. We took a different way back to our building so he wouldn't follow us, and dropped the dogs off as we were heading out to run some errands. When we walked outside, he was waiting for us, recording us and following us. I took my phone out to try and snap a picture of the guy and he blocked his face with his camera. I asked him if he always walked around with a stick to which he replied "Its none of your goddamn business" and I immediately turned around and made way to our car. We called the police immediately and an officer was sent out. He said hes spoken to the guy before and hes a bit unstable and very paranoid (and afraid of dogs) but doesn't know if its due to a mental health problem. He said we could not do anything in terms of him following us or recording since he lives in the complex. But he did give us a case number for a report that included information about a case between the guy and another guy in the complex and said hopefully it would help when we go to court. So my question is, how do these things usually work out? Can we be found at fault for a "bite" that never took place? And wouldn't it make more sense if you were afraid of dogs to remove yourself from the situation as opposed to approach the owner in a hostile manner? I don't understand how these things happen as we usually in control of our dogs (leashed, and leash trained). And how can you deal with a hostile neighbor such as this? Our dogs are not "unstable", the area where we usually walk him around includes 2 main streets (lots of traffic and pedestrians) and 2 secluded ones. Our dog is always alongside of us and always walks by people waiting for the bus, on bikes and such. EVERY morning. Which is why this incident is being taken completely serious and we're taking all necessary steps to defend our dog. And if we kept our dog inside all day he wouldn't be socialized, or exercised, or a happy dog! :)
