How can i tell if my turtle is dead?

I found a turtle next to a pond today (February 28), in Oregon, it has a red belly and his shell is a bit broken. The turtle Hasn't been moving, but when the tail is touched it moves it. I have it in warm water and it started to move a little, what should I do, and how do I take care of him? Is he dead? Please help! Also, his head isn't moving, and he isnt opening his eyes .... when you pick him up and move him his body flaps around...Please help
